Nature of the consultancy: The consultancy is in support of the improved security and labour market regulations in Armenia through strengthened management of work permit issuance system for foreign workers in Armenia.
Objectives of the consultancy: Legal support to the Government of Armenia in preparation of new legislative amendments in RA Law on Foreigners for implementation of work permit issuance system for foreign labour force, working in Armenia.
Target: Ministry of Labour and Social Affairs (MLSA) of the Republic of Armenia, State Employment Agency of the RA Ministry of Labour and Social Affairs, local employers, hiring foreign labour force.
IOM Project to which the Consultancy is contributing: “Strengthening Armenia Strengthening Armenia's Identity Management System” Project.
Tasks to be performed:
In close coordination with the IOM and Ministry of Labour and Social Affairs of the Republic of Armenia (MLSA), the consultant will:
a) Conduct desk research of available documents, legal acts and Government decrees on foreign labour registration/work permit issuance system of Armenia;
b) In close cooperation with the IOM International Expert and MLSA and based on the recommendations of the Needs and Gaps Assessment Report prepared by the IOM International Expert, Conceptual Recommendations, prepared by the MLSA with the IOM support as well IOM recommendations for amendments in Government decree No: 493, prepare draft package of legislative amendments for the Government of Armenia in the Law on Foreigners towards development of an effective system of implementation of Work Permit Issuance/Foreign Labour Force Registration system in Armenia, ensuring proper engagement of all related stakeholders; ensure compliance with Labour Code of the RA.
c) Meet with relevant government and non-government stakeholders;
d) Progressively report on implementation of the activities; submit prepared legislation; incorporate inputs by IOM Mission in Armenia and other stakeholders as suggested by the IOM Armenia;
e) Meet the deadlines set for the assignment.
Education, experience and competences:
a) Completed advanced university degree in Law. Education in a migration related field is an asset.
b) At least 5 years of experience in legal field, academic research and / or professional thematic consultancy.
c) Proven experience in similar tasks. Proven experience with international organizations, think tanks in conducting needs assessments, research and preparing guides, manuals, analytical reports, recommendations for draft legislation.
d) In depth knowledge of labour migration.
e) Excellent writing, communication and negotiation skills; ability to prepare clear and concise reports. Excellent analytical skills.
f) Excellent knowledge of English and Armenian languages is required.
Expected Duration of the Consultancy: May 03 – May 31, 2019.
a) Meetings with main stakeholders – by May 10, 2019. Page 3 of 3
b) First draft of legislation – by May 15, 2019.
c) Submission of the finalized legislation – May 20, 2019.
Tangible and measurable output of the work assignment:
- Draft legislation package for amendments in RA Law on Foreigners – May 20, 2019.
- Final consultancy report – May 31, 2019.
Realistic delivery date: No later than May 31, 2019.
Performance indicators for evaluation of results:
- Satisfactory completion of tasks indicated in the ToR.
- Compliance with the IOM Data Protection Principles.
- Quality of work.
- Timely delivery of drafts and deliverables as indicated these ToR-s.
- Adequate demeanour.
- Delivery of any other tasks indicated above.
About the project
The IOM project “Strengthening Armenia’s Identity Management System" aims to contribute to an improved identity management system for Armenian nationals and foreign citizens, in particular to improve labour market regulations through the implementation of work permit issuance system for foreign workers in Armenia. Project purposes include performing a gap analysis and need assessment on work permit issuance process in Armenia; developing Standard Business Process for work permit issuance system taking into consideration the best international practices; supporting drafting of secondary legislation.
